"GLP-1 Friendly": A Marketing Trend... or a Regulatory Risk?
The recent article published by El País, El Comidista highlights a growing trend in the food industry: products marketed as "GLP-1 Friendly." As consumer demand increases among users of GLP-1 medications such as Ozempic®, Wegovy®, and Mounjaro®, more brands are incorporating this claim into their packaging and marketing materials.
But an important regulatory question arises:
Would this claim comply with U.S. FDA labeling requirements if it appears on the Principal Display Panel (PDP)?
From a regulatory perspective, the answer is not straightforward.
Currently, the U.S. Food and Drug Administration (FDA) has not established or authorized "GLP-1 Friendly" as a recognized nutrient content claim or health claim. Unlike claims such as "High Protein," "Good Source of Fiber," or "Low Sodium," the expression "GLP-1 Friendly" is not defined in FDA food labeling regulations.
The concern goes beyond the wording itself. Today's consumers strongly associate the term GLP-1 with prescription medications used for weight management and diabetes treatment. Consequently, placing "GLP-1 Friendly" prominently on the Principal Display Panel (PDP) may create an implied message that the food is suitable for, supports, or enhances the effects of GLP-1 therapies.
Under the Federal Food, Drug, and Cosmetic Act, FDA evaluates labeling as a whole, including the overall impression conveyed to consumers. Even when a statement is not expressly prohibited, it may still raise regulatory concerns if it is considered false or misleading or if it functions as an unauthorized implied health claim.
For this reason, food manufacturers should carefully evaluate not only the wording of emerging marketing claims but also how consumers are likely to interpret them in today's marketplace.
